1. GENERAL TERMS
By downloading, accessing, or using the Disbate app or website (“Service”), you confirm that you agree to be bound by these Terms of Use (“Terms”). These Terms apply to all users of the Service, including visitors, account holders, content submitters, judges, and participants.
Disbate is operated by Mindcraft Inc., located at 3 Germay Dr, Wilmington, DE 19804, USA. If you do not agree with these Terms, you may not use the Service.
Disbate is a completely free platform. No payment, subscription, or purchase is required to access any of its core features.

2. NATURE OF SERVICE
Disbate is a video-based platform for intellectual confrontations and structured debates. Users may submit recorded arguments, challenge others, and participate in judging. The platform is designed for educational and developmental purposes and is provided entirely free of charge.

3. LICENSE GRANT
Disbate grants you a revocable, non-exclusive, non-transferable license to use the app and website for non-commercial purposes, in accordance with these Terms.

You agree not to:
- Sell, sublicense, or redistribute the app;
- Reverse engineer, decompile, or tamper with any part of the Service;
- Use the platform to spread misinformation, spam, or malware.

4. AGE RESTRICTIONS
You must be at least 13 years old to use the Service. If you are under the age of 18, you may use the platform only under the supervision and with the consent of a parent or legal guardian. Disbate does not knowingly collect information from users under 13.

5. USER-GENERATED CONTENT & RIGHTS
You retain ownership of the content you submit, but you grant Disbate an irrevocable, perpetual, royalty-free, worldwide license to:
- Display, share, reproduce, distribute, archive, and promote your submitted videos;
- Edit, subtitle, summarize, or format your videos for presentation, moderation, or accessibility;

Use submitted content in educational compilations, promotional materials, social media posts, media outreach, and public archives.
You waive any right to compensation or approval. Disbate may feature your video, in full or in part, across any media or platform, permanently.

6. COMMUNITY RULES
Disbate is built as a platform for respectful, intellectual exchange. By using Disbate, you agree to uphold a high standard of discourse and behavior. You agree to:
- Treat all users respectfully, regardless of nationality, religion, gender, age, or opinion;
- Debate issues, not people — no personal insults, bullying, or trolling;
- Avoid hate speech, slurs, or content that promotes violence or discrimination;
- Participate constructively, using logic and verifiable facts;
- Never submit manipulated, intentionally misleading, or plagiarized content;

Accept that moderators and judges have discretion to remove or silence submissions, ban users, or disqualify videos.
Disbate reserves the right to ban, suspend, or report any account that violates these expectations.

7. PROHIBITED CONTENT
You are strictly prohibited from uploading any video or content that includes:
❌ Explicit sexual content
❌ Non-explicit nudity involving intimate parts or kissing
❌ Obstructed intimate parts or suggestive focus
❌ Any form of violence, abuse, or threats
❌ Visually disturbing content, including blood, gore, or trauma
❌ Drug or tobacco use, including promotion or paraphernalia
❌ Alcohol consumption, glorification, or underage drinking
❌ Obscene gestures or lewd motioning
❌ Gambling, lotteries, betting, or related links
❌ Hate symbols (e.g., Nazi insignia, extremist flags)
❌ Extremist content, including glorification of terrorism or violent ideologies

8. MODERATION AND AI USE
Disbate may both use AI moderation tools and human oversight to assess content and ensure platform integrity.

You understand:
- AI may assist in flagging or scoring submissions;
- Final decisions rest with human moderators or community judges;
- Errors may occur, and content may be reviewed or reinstated upon appeal.

9. PRIVACY AND DATA HANDLING
Disbate collects minimal data to provide services, including login credentials, IP address, and activity history.

To request data deletion, email feedback@disbate.com. We comply with GDPR, CCPA, and other privacy standards.

10. COOKIES
We may use cookies to manage session login, analytics, and improve performance. Disabling cookies may limit site functionality.

11. THIRD-PARTY SERVICES
The Service may link to or embed third-party platforms. Disbate is not responsible for their content, privacy policies, or service availability. Use them at your own risk.

12. TERMINATION
Disbate may suspend or delete your account at any time if you violate these Terms.

We also reserve the right to:
- Remove any video at our discretion;
- Disable or archive accounts inactive for prolonged periods;
- Refuse future registration attempts by banned users.

You may close your account at any time by contacting feedback@disbate.com.

13. NO PAYMENT OR REFUNDS
Disbate is a 100% free platform. There are:
- No in-app purchases;
- No subscriptions;
- No premium content;

And no refund policy, since no financial transactions occur.

14. DISCLAIMER OF WARRANTIES
The Service is provided “AS IS” and “AS AVAILABLE”, without any warranties of fitness, performance, or reliability.

We do not guarantee:
- Uptime or uninterrupted access
- Accuracy or neutrality of submitted content
- Moderator or judge outcomes
- Use of the platform is entirely at your own risk.

15. LIMITATION OF LIABILITY
Disbate is not liable for any:
- Lost data, account access, or content;
- Personal harm, emotional distress, or reputation damage;
- Errors in moderation or platform decisions;
- Indirect, incidental, or consequential damages.
- Your sole remedy is to stop using the Service.

16. ARBITRATION AND DISPUTE RESOLUTION
Any disputes between you and Disbate shall be resolved through binding arbitration under AAA rules in Wilmington, Delaware, except for intellectual property disputes or urgent injunctive relief.  Before arbitration, the parties agree to a 60-day good-faith resolution period via written notice.
You waive the right to jury trial and class-action lawsuits.

17. GOVERNING LAW
These Terms are governed by the laws of the State of Delaware, USA.

18. SEVERABILITY AND WAIVER
If any provision of these Terms is deemed invalid, the remainder remains enforceable.  Failure to enforce a clause shall not waive the right to enforce it later.

19. FORCE MAJEURE
Disbate is not liable for delays or disruptions caused by events beyond our control, including:
- Natural disasters
- Internet outages
- Pandemics
- Government actions
- Technical failures

20. PROMOTIONS AND CONTESTS
Any contest or promotion may be subject to additional rules regarding eligibility, age, region, and entry conditions. By entering, you agree to those rules.

21. EXPORT CONTROL
You may not use or export the Service in violation of U.S. law or to sanctioned countries or individuals on U.S. embargo or denial lists.

22. SUBMISSIONS AND CONFIDENTIALITY
All ideas, feedback, or content submitted become non-confidential and may be used by Disbate without credit or compensation.
Disbate reserves full rights to repurpose and redistribute such content in any form.

23. INJUNCTIVE RELIEF
Disbate reserves the right to seek injunctive or equitable relief, without bond or proof of damages, in the event of violation or attempted circumvention of these Terms.

24. TYPOGRAPHICAL ERRORS
In the case of a mistake in displaying content, functionality, or service features, Disbate reserves the right to correct or revoke affected components without prior notice.

25. ENTIRE AGREEMENT
These Terms, along with the Privacy Policy and any posted community rules, constitute the entire agreement between you and Disbate.
They supersede any previous oral or written agreements.

26. LANGUAGE
These Terms are written in English. If translated, the English version takes precedence in case of conflict.
